New York (AP) — New York Metropolis is suing greater than a dozen constitution bus firms for $700 million, accusing them of illegally transporting tens of hundreds of migrants from the southern border to the town beneath the route of Texas Gov. Greg Abbott.

The lawsuit accuses 17 bus firms of taking part in a “unhealthy religion” relocation plan that violates state restrictions on abandoning “needy individuals” in New York. It seeks monetary damages to cowl the price of caring for an estimated 33,000 migrants which have arrived within the metropolis on constitution buses for the reason that spring of 2022.

Filed in state courtroom Thursday, the lawsuit marked the newest effort by a Democratic mayor to show again busloads of asylum seekers despatched by the Republican governor of Texas. The state has despatched greater than 95,000 migrants to so-called sanctuary cities, together with New York, Chicago and Denver, in protest of President Joe Biden’s immigration insurance policies, Abbott mentioned final month.

Amid a rise in bus drop-offs, each New York Metropolis and Chicago introduced new restrictions in latest weeks mandating the constitution firms to supply superior discover of their arrivals. Inside days, most of the buses started leaving migrants in suburbs surrounding every metropolis with out prior discover, drawing anger from native officers.

On Thursday, New York Metropolis Eric Adams, a Democrat, mentioned the town would now not “bear the prices of reckless political ploys from the state of Texas alone,” including the lawsuit ought to “function a warning to all those that break the regulation on this approach.”

A number of the bus firms appeared caught off guard by the go well with. “We don’t make insurance policies,” mentioned David Jones, an worker at Buckeye Coach LLC, one of many constitution firms named within the lawsuit. “We’re only a transportation firm.”

Representatives for the opposite constitution firms — most of that are primarily based in Texas — both declined to remark or didn’t instantly reply to inquiries.

The latest give attention to the non-public constitution firms, the Adams administration mentioned, was pushed partly by authorized protections afforded to the state of Texas beneath a doctrine generally known as sovereign immunity.

The lawsuit rests on a provision of state regulation that bars knowingly transferring “a needy particular person from out of state into this state for the aim of creating him a public cost.”

The go well with cites a report discovering that for the journeys, the constitution bus firms obtain roughly $1,650 per particular person — far larger than the price of a typical one-way bus ticket — as a testomony to the businesses’ “unhealthy religion” involvement within the scheme.

In a press release, Gov. Abbott mentioned the go well with was a transparent violation of the commerce clause, which ensures the constitutional proper to journey.

“Each migrant bused or flown to New York Metropolis did so voluntarily, after having been approved by the Biden Administration to stay in america,” Abbott mentioned. “As such, they’ve constitutional authority to journey throughout the nation that Mayor Adams is interfering with.”

Murad Awawdeh, govt director of the New York Immigration Coalition, described the authorized motion as a distraction from the bigger points dealing with New York, arguing Mayor Adams must be centered on serving to migrants get on their toes.

“This lawsuit is another approach for the mayor to scapegoat another person for his lack of administration of the state of affairs,” Awawdeh mentioned. “He must cease taking pages out of Governor Abbott’s playbook and step up and lead the town of New York.”
