Nationwide — In Adams County, Mississippi, 41-year-old Reginald Butler, an African American man, is going through felony aggravated assault prices and a $50,000 bond regardless of what seems to be a transparent case of self-defense beneath the state’s personal Stand Your Floor legal guidelines. Butler was reportedly attacked by a bunch of white males in Adams County, fled the scene on a bicycle, and was later confronted a second time by one of many males concerned. In keeping with witness statements, the white man exited a automobile and bodily assaulted Butler once more, prompting Butler to shoot him within the chest. The person survived and was airlifted to a medical facility, whereas Butler was later taken into custody and charged.

In keeping with WLBT, the Adams County Sheriff’s Workplace initially claimed it was “unclear” who the aggressor was throughout the second confrontation. However after an investigation involving the Mississippi Bureau of Investigations and the FBI, authorities confirmed that Butler was not the aggressor in both incident. Regardless of that, Sheriff Travis Patten insisted that Butler’s arrest couldn’t be undone now that prices had been filed. The case will nonetheless transfer to the district lawyer, who will current it to a grand jury for a call on whether or not to pursue prosecution.

Video proof and witness accounts reportedly affirm Butler’s story. The truth is, a part of the preliminary assault — the place Butler was jumped by three white males whereas minding his personal enterprise — was captured on video. That assault left him injured and fleeing for security. After in search of medical consideration and retrieving a firearm legally from a close-by good friend’s home, Butler rode again towards the world, solely to be assaulted once more on a close-by bridge. In response to being attacked a second time, Butler fired his weapon.

The sheriff has now confirmed that a minimum of one of many white males who attacked Butler within the first incident, Cameron Taunton, has been arrested and charged with easy assault. One other particular person, 21-year-old Houston Lee Fairly, has been charged with aggravated assault and conspiracy to commit aggravated assault. However regardless of these developments and a transparent acknowledgment that Butler was not the aggressor, the very fact stays: the one individual going through a felony cost up to now is the Black man who defended himself.

This raises a essential and all-too-familiar query within the Black group: why is a person who stood his floor in opposition to an attacker — and did so solely after being bodily assaulted — the one being prosecuted? Mississippi is certainly one of 38 states with Stand Your Floor legal guidelines, which theoretically permit people to make use of power in the event that they consider they’re in imminent hazard. Nevertheless, these legal guidelines have been broadly criticized for being erratically utilized, typically working in favor of white defendants whereas criminalizing Black victims of violence for defending themselves.

Sheriff Patten has promised transparency and says the investigation is ongoing. However many are already drawing consideration to what they see as one other instance of racial injustice. “Hate has no place in our society,” Patten acknowledged, whereas acknowledging group outrage over Butler’s arrest. For now, Reginald Butler’s destiny hangs within the steadiness — not simply in a courtroom, however in a justice system the place Black victims nonetheless too typically turn out to be the accused.
