By Robert J. Hansen, The Sacramento Observer

Whereas attempting to make a public remark on the June 20 Sacramento Metropolis Council assembly, Samuel Kinsey broke down in tears after watching a video during which a 10-year-old Black woman was put in handcuffs by a Sacramento police officer.

“We’re hurting,” a girl mentioned whereas comforting Kinsey.

The video of Sacramento police handcuffing the crying 10-year-old woman was introduced by the Workplace of Public Security Accountability (OPSA) to the Metropolis Council amongst its findings in an audit of misconduct grievance circumstances within the Sacramento Police Division.

Within the video, taken in February of final 12 months, male officers conducting a probation search are seen screaming at individuals inside to open the door, grabbing and forcibly shaking the house’s steel display.

OPSA Director Dr. LaTesha Watson mentioned handcuffing the younger woman was fully pointless. She confirmed in an interview that the officer was not reprimanded or disciplined as a result of the police division mentioned his actions have been justified.

“One factor you must take note of as a police chief is— sure, stuff will be justified— however was it needed?” Watson mentioned. “This was not needed.”

Watson spoke with the kid’s mom, who informed her that due to that interplay her daughter is now afraid of the police.

“I don’t need a toddler to be afraid of the police division. That isn’t our function,” Watson mentioned. “I want I’d have been in a position to meet along with her in particular person in order that she may see that somebody that appears like her remains to be in policing.”

Watson mentioned if Black individuals proceed to be handled this manner, they are going to by no means need to be cops.

OPSA Inspector Basic Dwight White mentioned he believes race did play an element within the handcuffing of the younger Black woman.

“She shouldn’t have been handcuffed even for a second,” White mentioned. “If this woman was one other race, she doubtless wouldn’t have been handcuffed.”

The audit concluded that the kid, who was handcuffed instantly upon the door opening, clearly posed no menace; that the incident was clearly traumatic to the kid; and that it definitely will form her view of cops sooner or later.

A coverage outlining procedures in coping with minor kids would profit officers and result in fewer traumatized kids sooner or later, OPSA beneficial.

Mayor Darrell Steinberg mentioned that if regulation enforcement and the neighborhood can’t agree that there’s a systemic drawback round race, town will not be going to have the chance to enhance collectively.

“The audit is about race,” Steinberg mentioned. “I’m sorry, that’s what it’s about.”

Steinberg mentioned there might be a time to debate trendy policing inside the police division, however that the audit highlights a racial drawback with regards to search and seizure.

“I believe we will all agree that regardless of our opinion on regulation enforcement … nobody ought to have their constitutional rights violated,” Steinberg mentioned.

Chief Kathy Lester agreed with elements of the audit and offered useful suggestions. She disagreed, nevertheless, that racial bias in search and seizures is systemic.

OPSA reviewed 109 complaints of SPD complaints of misconduct between 2020-2022. OPSA decided that 38 of the 109 accomplished misconduct grievance circumstances reviewed contained Fourth Modification violations.

Lester mentioned highlighting 109 audited complaints amongst 770,000 encounters her officers had with the general public final 12 months doesn’t help allegations of improper conduct.

Councilmember Mai Vang pushed Chief Lester on that.

“If we will’t acknowledge the inequalities in our system, we could have already failed,” Vang mentioned.

Chief Lester responded by saying, “I believe there’s bias all through the neighborhood. Definitely, if it happens in the neighborhood it’s going to happen inside the division.”

Mayor Steinberg harassed the significance of implementing the beneficial insurance policies, citing a current California Division of Justice report on SPD.

“Except an investigation resulted in a self-discipline suggestion, lower than half of SPD’s investigative case information contained an in depth narrative of the allegations within the proof gathered,” Steinberg mentioned to Chief Lester. “I take it you’re working with [OPSA] on this?”

Iysha Jenkins with African American Workers Management Council mentioned the audit’s findings demand instant consideration and motion.

“This report is per the shortage of help Black metropolis workers obtain,” Jenkins mentioned. “Severe points exist inside a few of the metropolis’s departments together with the police division and fireplace division. OPSA’s audit exposes this habits.”

OPSA’s audit additionally discovered that the biggest proportion of accomplished misconduct grievance circumstances with sustainable Fourth Modification violations arose from improper searches and seizures associated to cell telephones, illegal detention throughout visitors stops, illegal pat-downs and illegal warrantless residential searches.

Greater than half the complaints of improper search and seizure obtained in the course of the evaluation interval stemmed from visitors stops.

SPD doesn’t have a present coverage on the Fourth Modification together with search and seizure.

Based on the audit, SPD’s search and seizure guide from 2007 must be up to date, because it solely generically describes search and seizure points.

“It’s unclear how SPD distinguishes a guide from a coverage,” the audit mentioned.

That is important as a result of the USA Supreme Courtroom, federal district court docket and California state courts have issued a number of important selections pertaining to the Fourth Modification since 2007.

The audit discovered a number of examples of allegations of improper search and seizure that progressed by way of a number of ranges of SPD supervision with out recognition of Fourth Modification violations.

Stops primarily based on minor visitors infractions with no obvious intent to implement the infraction or ticket the driving force turn out to be pretextual stops, in line with the audit. The visitors cease can turn out to be illegal whether it is unnecessarily extended for a matter unrelated to the aim of the cease.

Such pretext stops can deteriorate relationships inside the neighborhood between residents and the police, OPSA mentioned.

The audit discovered each grievance concerning the conduct of visitors stops for unlawful window tint was filed by a Black or Latino driver.

The audit additionally included the next suggestions:

SPD ought to require officers’ reviews to articulate why they stopped a citizen and/or why they felt the necessity to pat down the particular person.

The division ought to set up a transparent, detailed coverage on pat-downs, investigatory stops and investigative detentions.

SPD ought to present coaching to new recruits and cops on investigatory stops, pat-downs, cheap suspicion and Fourth Modification fundamentals.
