Texas has abruptly rewritten the principles of its state contracting system, stripping girls and minority-owned companies of a long-standing assist program and reshaping it completely round disabled veterans.

The Texas Comptroller’s workplace introduced Tuesday (Dec. 2) that the Traditionally Underutilized Enterprise (HUB) program, created by lawmakers to provide deprived companies a lift in securing state contracts, will now not acknowledge race, ethnicity, or intercourse as qualifying components. As an alternative, this system can be rebranded as Veteran Heroes United in Enterprise (VetHUB) and restricted to veterans with a minimum of a 20% service-connected incapacity.

The adjustments took impact instantly by emergency guidelines, dramatically narrowing a program that has existed for many years. Although the HUB initiative by no means set hiring quotas, it established participation objectives many state businesses aimed to fulfill, serving to licensed companies achieve visibility and compete for main public contracts.

Beneath the brand new guidelines, 1000’s of companies will lose that foothold.

In keeping with the Comptroller’s workplace, any HUB certification tied to an proprietor’s gender, race, or ethnicity was revoked on Tuesday. Distributors obtained emails informing them that their certifications had been canceled and that their corporations can be faraway from the state’s HUB listing. Ongoing state contracts won’t be disrupted; nonetheless, any new or renewed certifications associated to these classes are actually off the desk.

Comptroller Kelly Hancock defended the choice in a written assertion, framing the overhaul as each a constitutional correction and a tribute to veterans.

“Our nation’s veterans have all the time stepped up for us. VetHUB is Texas’ approach of stepping up for them — slicing pink tape, restoring constitutional integrity and opening doorways for the women and men who wore our nation’s uniform,” Hancock stated. “These emergency guidelines guarantee Texas’ state contracting is free from gender or race discrimination.”

The shift follows a freeze the company positioned on new and renewed HUB certifications on the finish of October. On the time, officers cited a must overview this system’s compliance with govt orders issued by each President Donald Trump and Governor Greg Abbott, which prohibited variety, fairness, and inclusion efforts in authorities. Hancock additionally posted on social media that the pause was meant to finish “race or intercourse quotas” in state procurement.

The timing comes as a separate lawsuit filed by an organization that doesn’t have HUB certification and claims it misplaced contracts due to its transfer by federal court docket. No ruling has been issued in that case.

What stays unclear is the authorized footing behind the Comptroller’s unilateral overhaul. The HUB program was created in state statute, which means vital coverage adjustments usually require motion by both the Legislature or a court docket. The company has not publicly defined what authority it’s counting on to bypass that course of.

For now, Texas’ small-business panorama has shifted in a single day, and 1000’s of entrepreneurs are left navigating the fallout.

A program designed to widen the door for underserved companies now opens it to just one group, and the authorized questions could be starting.
