Manhattan D.A. Alvin Bragg desires to know why the identical precise racially motivated assault can’t be charged as a hate crime if the sufferer was attacked by a bunch of individuals as an alternative of a person. Effectively he is aware of why, he’s simply befuddled by the logic: assault is chargeable as a hate crime, however gang assault—when the suspect is “aided by two or extra different individuals really current”—is just not.

The newly-introduced Hate Crimes Modernization Act would shut such a loophole by increasing the variety of hate crime chargeable offenses from 66 to 97 statewide. Bragg introduced the invoice alongside sponsors State Senator Brad Hoylman-Sigal and Assemblymember Grace Lee earlier this month.

“Whether or not you reside in Harlem, Chinatown or Hell’s Kitchen, no neighborhood is immune from experiencing hate crimes,” stated Bragg over e-mail. “Bias-related harassment and violence are unacceptable, and this new laws is a commonsense repair that addresses loopholes within the present statute. Including to the listing of eligible hate crimes offenses will assist deter these acts by bringing further circumstances and goes hand in hand with our neighborhood outreach efforts to make sure victims really feel comfy reporting incidents to their native precincts and to our Workplace.”

“As we witness an unprecedented rise in bias-motivated crimes towards Jewish, Muslim, Asian American, Black, and LGBTQ folks, it’s of utmost significance that New York closes the handfuls of loopholes in our hate crime statute to ship the pressing message that hatred gained’t be tolerated in our state,” added Hoylman-Sigal. “I’m proud to introduce the Hate Crimes Modernization Act (S7737) with District Lawyer Bragg and Meeting Member Lee, which can give prosecutors the required instruments to take acceptable motion towards hate. With this invoice, we will defend New Yorkers of differing backgrounds.”

The 31 proposed offenses lined by the invoice embrace first-degree homicide and second-degree rape. Second-degree homicide and first-degree rape are already on the hate crime statute. False reporting of an incident may be charged as a hate crime if the invoice because it stands passes.

In response to the Manhattan D.A.’s Workplace, anti-Black hate crimes at the moment account for the fourth most open circumstances in New York County, behind anti-Asian, anti-LGBTQ, and anti-Semitic offenses. Citywide, there have been 4 anti-Black hate crimes reported by the NYPD final month and 43 this 12 months as of Oct. 31.

“New York is at the moment experiencing an unprecedented epidemic of hate, and this contains anti-Black hate crimes, which is likely one of the commonest types of hate crimes in Manhattan,” stated Lee over e-mail. “The Hate Crimes Modernization Act will defend susceptible communities, together with New York’s Black neighborhood, by equipping our legal guidelines to handle hate crimes once they happen. Each time a hate crime goes unrecognized, its victims are denied justice, and hate is additional normalized and allowed to unfold.

“This invoice will empower minority communities by validating victims’ experiences, and it delivers a transparent message that hate has no place in New York.”

District Attorneys of the opposite 4 boroughs additionally supplied their stamps of approval.

“The Hate Crimes Modernization Act provides dozens of great crimes to the penal legislation making certain better accountability for individuals who commit violence with hate of their hearts,” stated Bronx D.A. Darcel Clark in a press release. “Our metropolis has seen a file variety of hate crimes, and we could have extra instruments responding to ignorance and prejudice.”

“Prosecutors want the power to reinforce bias motivated offenses each time they happen, and the Hate Crime Modernization Act would enable us to do exactly that,” added Brooklyn D.A.
